Kitany claims to multi-million assets uncertain after divorce ruling – Business Daily

Maryanne Kitany’s fight for multi-million properties with Mithika Linturi is now uncertain after a Nairobi court dismissed a divorce case she filed in 2019.
A Milimani court dismissed the case on Tuesday saying that Ms Kitany, who is also the Aldai MP, failed to prove that they were legally married.
Mr Linturi and Kitany are fighting for the control of several properties including the matrimonial homes in Maua, Meru County and Mae Ridge Country Villas in Runda, a parcel of land in Kitengela and 5 other parcels in Kajiado/Kaputiei North, two vehicles- a Range Rover and Toyota Lexus.
They are also fighting over money in several banks and shares at Atticon Ltd, Litany Investments Ltd, Ark Business solutions Ltd, Arkchoice Insurance Brokers Ltd, Arkchoice Pharmaceuticals, Arkgroup Ltd and Fancy Solutions Ltd.
Mr Linturi is also fighting claims of forgery and borrowing loans amounting to Sh500 million using a contested company- Atticon, without the consent of other directors.
Ms Kitany said the two met while she served as chief of staff at then Deputy President William Ruto’s office in 2013.
She told the court that Mr Linuri had come to see Mr Ruto being a newly elected MP for Igembe South and she was instructed to assist him.
Before getting married, they allegedly cohabited in her house in Kileleshwa and they later bought the Mae Ridge Villa property in 2015.
She said the architectural drawings were under her name and that she was the one who supervised the construction. She also claimed that she spent Sh26 million to renovate Mr Linturi’s Meru home.
But chief magistrate Heston Nyaga dismissed the case and said she sympathises with her for believing that the marriage existed.
The woman moved to court seeking to seek protection after the former legislator threw her out of the house. She has been residing in the house courtesy following a court order.
The magistrate said witnesses called by the MP could not agree on the exact dates when the alleged customary marriage took place.
Ms Kitany had claimed that she got married to Mr Linturi in April 2016 after undergoing the Nandi and Meru customary marriage.
She claimed that the former MP paid a dowry of Sh100,000 on top of other goodies for her hand in marriage.
The court, however, said Mr Linturi was still married to another woman identified as Mercy Kiamenyi and the customary marriage claimed by Ms Kitany could not suffice.
Ms Kitany through her advocate applied for the suspension of the decision, pending appeal. A ruling on the application will be made on Friday.
Mr Linturi claimed that he only hosted her on compassionate grounds after she lost her job in 2017 in Dr Ruto’s office.
He said he met her in 2013 and she pleaded to be accommodated temporarily in one of his houses and be allowed to establish a small office in one of the rooms.
